5 Common Client Money Compliance Myths Every Letting Agent Should Know

Chloe Grima ·

Client Money

Client money compliance is a fundamental responsibility for letting agents, helping to safeguard funds held on behalf of landlords and tenants.

However, misconceptions surrounding Client Money Protection (CMP) requirements and financial reporting can lead to misunderstandings about an agency's obligations.

Here, we examine five common compliance myths and explain what letting agents need to know.

1. Only tenant deposits need to be held in a ring-fenced client account

The reality:

Client money extends beyond tenancy deposits. Rent collected on behalf of landlords and other funds held for clients must also be managed appropriately.

Under the Client Money Protection requirements in England, agents covered by the regulations must hold client funds in an appropriately designated account, separate from their business finances.

This separation helps protect client funds, maintain financial transparency and reduce the risk of money being incorrectly allocated or used.

2. CMP compliance only needs to be considered when renewal is due

The reality:

CMP compliance is an ongoing responsibility, not simply an annual requirement.

As letting agents handle client money throughout the year, accurate record-keeping, regular reconciliations and effective financial controls must be maintained consistently.

Taking a proactive approach to client accounting helps agencies identify discrepancies early and remain prepared for compliance reviews.

3. If my client account balances, my client money must be correct

The reality:

A balanced client bank account does not necessarily mean the underlying financial records are accurate.

Incorrectly allocated payments, missing transactions or discrepancies within individual landlord accounts may still exist, even when the overall balance appears correct.

Regular reconciliations between bank statements, accounting records and individual client balances are therefore essential for maintaining financial accuracy.

4. An accountant's report is the only option for meeting client money reporting requirements

The reality:

Traditional accountants' reports are not necessarily the only option available to letting agents.

Depending on their CMP scheme and eligibility, agents may be able to use an independent CMP HealthCheck as an alternative.

For eligible agencies, this can offer a more streamlined and cost-effective approach to reviewing client money procedures. However, agents should always confirm their scheme's specific requirements.

5. Displaying a CMP logo on my website is sufficient

The reality:

Displaying a CMP logo alone does not satisfy the relevant certificate display requirements.

In England, property agents subject to mandatory CMP requirements must display their CMP membership certificate on their website, where one exists.

The certificate must be current and accurately reflect the agency's membership.

Failure to comply can result in a financial penalty of up to £5,000, as outlined in the UK Government's CMP guidance.

Understanding Your Compliance Responsibilities

Effective client money compliance requires accurate records, strong financial controls and a clear understanding of regulatory responsibilities.

By addressing common misconceptions, letting agents can strengthen their procedures and reduce the risks associated with handling client funds.

At the Letting Partnership, we support letting agents through specialist client accounting services and independent compliance reviews, helping them maintain effective financial processes and protect client money.

Ultimately, compliance is not just about meeting annual requirements, but maintaining the right standards throughout the year.
